Sophomore faces third-degree felony charge

Allegany Police arrested St. Bonaventure University sophomore William Markey and charged him with third-degree rape following an incident in Devereux Hall early Saturday morning, according to an Allegany Police Department press release.
Third-degree rape constitutes an instance in which the victim is incapable of providing consent. He was released to his parents on $1,000 bail.
Rick Trietley, vice provost for student life, confirmed police arrested Markey, a St. Bonaventure golf team member, Saturday evening at about 5:45 p.m. The court issued him a no-contact order, preventing him from any type of interaction with the victim.
Trietley said Markey has been restricted from coming onto campus for any reason whatsoever, based on the court order.
Vito Czyz, director of Safety and Security, said security officials responded immediately to a call around 4 a.m. Saturday morning.
"We started asking questions as far as what happened and tried to follow leads," Czyz said. "The Allegany Police Department arrived shortly thereafter. We then began knocking on doors, trying to find anyone who matched the description that we received."
Czyz said Markey had come forward to another student, who then assisted officials with the investigation.
Trietley said officials remain unsure if alcohol was a factor, but they do not believe it facilitated the alleged incident.
The university holds a number of options as to how to discipline Markey from an academic standpoint, regardless of his trial's findings.
"They include everything from summary suspension all the way to possible judicial board and expulsion," Trietley said. "I can't (comment on what will happen). I can say, though, that we do have the policies and procedures on the books to do what's right."
